Real estate law is the collection of rules enforced by the real estate legal authority. Real estate law regulates the characteristics and level of real estate property. In other words real estate law can be defined as the rules which regulate the disposition of the overall property. Real estate and property is normally regarded as one of the most expensive acquirement. So people should take the legal advice while dealing with real estate matters. People should look for a reliable and experienced advisor while purchasing real estate matters. Real estate law can be classified as federal and estate planning laws. Some other components under real estate law are estate and probate, estate taxes, living wills etc. One should also take some factors into consideration like creation of trusts, legal validity of wills, probate process etc.
Variety of real estate law
Law regarding estate taxes: Generally the state authority enforce the estate taxes. Normally one tax rate is applied to all the assets of the estates. Sometimes the tax rate may vary according to the type of the property. For example comparatively lower taxes are levied on the property of a child.
Agricultural law: Agricultural law is the most common one which comprises the law of contracts, law on criminal, nuisance, bailments, environmental (both state and federal), property, wills etc.
Law against selling or buying a home: Normally people take help of an estate agent or broker while estate owner going to sell his home. For hiring a broker the estate owner needs to pay commission.
Law against commercial real estate: Commercial real estate law comprise some rules regarding mortgage matters, zoning, insurance etc. This law also deals with construction, taxes and landlord- tenants problems.
Law against condemnation: Condemnation can be defined as a process of utilization of private property for public use. In the event the government take that private property, the owner will get the compensation.
Construction law: This law maintains an agreement which is normally signed by a builder and homeowner.
Some other law matters regarding real estate property are landlord and tenant law, mortgage law etc.
