The Energy Efficiency Act (RSBC 1996) Chapter 114 defines energy devices as any sort of device that affects energy consumption or is run by energy. Products that are used to control the flow of energy are also defined as energy devices according to this act. The Act also determines the standards of efficiency that energy devices are expected to meet.
The Energy Efficiency Act restricts manufacturers from producing energy devices that are below the determined energy efficiency standards. Moreover, any kind of trade or leasing of below standard energy devices are also restricted by the Act. Energy efficient devices can be sold only when they are offered with a prescribed label that guarantees the energy efficiency of the particular device. This Act restricts all manufacturers or sellers from pasting any kind of label of energy efficiency on a product that fails to meet the prescribed standards of efficiency. It also states that all energy devices that are produced before a particular date are exempt to its rules and regulations. This Act is also not meant for individuals and groups who are not related to the manufacturing or trading of energy devices that come under this Act.
The Energy Efficiency Act also defines the entire process of inspection and testing. An inspector, recruited by the minister under this act, has the right of inspecting any such place where those energy devices are manufactured or stored that comes under this Act. At the same time, the inspector can also enter in any premises where these energy devices are sold, purchased or provided on lease. The inspector also has the authority to take away an energy device for the purpose of testing and also has the responsibility to return the device to its owner. He or she can also ask for relevant documents for the same purpose. On the other hand, the powers provided by this Act should not be used to enter any such place where these particular energy devices are not manufactured or sold.
The Energy Efficiency Act further describes that any kind of obstruction should not be created when the inspector is carrying out any kind of investigation related to the energy devices. If any such obstruction is created, any wrong information is provided or cooperation is not offered, it is considered as an offence under this Act. Disobeying any other provisions of this Act is also an offence.
The Lieutenant Governor in Council has been provided with several powers through which this Act can be properly implemented.
