The ADGM Arbitration Center recently announced the launch of its brand new online dispute resolution platform. According to the company, the platform comes in response to growing demand for its services as a premier dispute resolution hub.
Known as ODR@ADGM, the new platform represents a major leap in online dispute resolution. According to ADGM, it will offer a fully digitalized service for mediation and settlements. Furthermore, the platform was designed to accommodate a global audience.
As such, it will allow parties from any location to engage in dispute resolution, whether by using self-guided negotiations or by using internationally accredited mediators.
The company also claims that ODR@ADGM is fully confidential and secure platform, with special emphasis on the autonomy of the parties involved in resolving disputes. Users will also be able to access it at any time, remotely and effortlessly, using the company’s website.
How does the platform work?
The process of resolving disputes is pretty simple and straightforward. As ADGM explained, parties will be able to submit a dispute on ODR@ADGM and, in addition, answer a series of questions. This will help the platform with formulating a tailored settlement offer, which the first party will be able to offer to the second party.
Once both of them are on the platform, they can start negotiating with some fairly flexible deadlines. The goal is to try and find a solution that will work for both parties, so the process itself needs to suit their individual schedules and needs.
If a settlement can be reached, the platform will then provide a template settlement agreement, which will allow the parties involved to reach a self-driven resolution. However, they will also have another option, which is to draft their own agreement with legal help assisting them.
However, not every dispute will be able to reach a resolution easily, and sometimes, the negotiations might not lead to a settlement. In such situations, the parties will also be able to opt for mediation. If it comes to this, and the mediator has to get involved, they will work diligently and confidently in order to help the parties find some common ground and reach a compromise that all members will find acceptable.
The new platform is the next step in ADGM’s digital innovation
Using ODR@ADGM for resolving disputes will save significant amounts of both time and money, according to ADGM. Furthermore, it will allow businesses to resolve disputes without having to suffer disruptions in their day-to-day operations.
It is not the first initiative of this kind, as it comes after solutions such as the Mediation in the Metaverse, as well as ADGM Courts’ use of blockchain technology for enforcing commercial judgments globally.
Even so, it represents the next step in ADGM’s continuous digital innovation, as explained by the Registrar and Chief Executive of ADGM Courts, Linda Fitz-Alan. She noted that the world is rapidly evolving, and it is necessary for ADGM to do the same. With that in mind, ODR@ADGM comes as a new, accessible tool for resolving disputes while the parties involved get to remain in control of the resolution.
She also added that the tool offers accessibility, speed, and autonomy as key principles of the platform. “Importantly, this new platform allows us to continue our mission of expanding the reach of mediation as a preferred form of dispute resolution. ADGM is once again proving that there is a myriad of ways to shift the paradigm of dispute resolution, bringing sustainability to the fore,” Fitz-Alan said.
